These Terms govern safetechbuilders.com and all related webpages, online forms, calculators, portals, appointment tools, chat features, communication systems, and online services (collectively, the “Website”).
1. Acceptance of These Terms
1.1 You accept these Terms when you check a box or click a button indicating agreement, submit a form, request an estimate or inspection, schedule an appointment, or otherwise use the Website after being presented with a link to these Terms.
1.2 If you do not agree to these Terms, do not use the Website and do not submit information through it.
1.3 You represent that you are at least 18 years old and legally able to enter into this agreement.
1.4 Our Privacy Policy is incorporated into these Terms by reference. By accepting these Terms, you also acknowledge the Privacy Policy.
2. Definitions
The following terms have the meanings given below wherever they appear in these Terms.
- “Website” means safetechbuilders.com and all related webpages, forms, calculators, portals, appointment tools, chat features, communication systems, and online services operated by or on behalf of SafeTech.
- “Services” means roofing, construction, hurricane impact window, hurricane impact door, inspection, repair, replacement, and related property-improvement services offered by SafeTech.
- “Signed Contract” means a written construction contract or proposal executed by SafeTech and the property owner or other authorized party.
- “Preliminary Estimate” means any online estimate, calculator result, price range, financing illustration, preliminary proposal, aerial measurement, drone assessment, photograph review, telephone discussion, or text-message estimate that is not expressly identified as final in a Signed Contract.
- “Marketing Communication” means a call, text message, email, or other communication whose purpose is to encourage the purchase of goods or services.
- “Transactional Communication” means a communication reasonably necessary to an existing inquiry, appointment, estimate, Signed Contract, active project, payment, warranty, safety matter, service request, or legal obligation.
- “Service Provider” means a third party that processes information on SafeTech’s behalf under contract, including JustCall and SafeTech’s customer-relationship management provider.

SafeTech Builders Inc. is a Florida contractor providing roofing, construction, hurricane impact window, hurricane impact door, inspection, repair, replacement, and related property-improvement services.

4. Service Area
4.1 SafeTech provides Services in South Florida and in other Florida markets it serves from time to time. Service areas change based on licensing, staffing, permitting, and operational capacity.
4.2 Listing a city, county, or region on the Website does not guarantee that SafeTech is currently accepting projects in that area or that it will perform work at a particular property.
5. Electronic Communications and Electronic Signatures
5.1 You consent to receive communications from SafeTech electronically, including by email, text message, and postings on the Website.
5.2 You agree that electronic communications, agreements, notices, disclosures, and records satisfy any legal requirement that they be in writing.
5.3 You agree that clicking a button, checking a box, or typing your name constitutes your electronic signature under the federal E-SIGN Act and the Florida Uniform Electronic Transaction Act.
6. Website Information Is General Information
Information on the Website is provided for general informational, educational, and marketing purposes only. It does not replace:
- An in-person property inspection
- A roof or building evaluation
- An engineering report
- A written construction proposal
- A Signed Contract
- A permit review
- A building-code determination
- An insurance-coverage determination
- Manufacturer installation instructions
- Professional legal, financial, engineering, or insurance advice
Requirements vary by property and project. Relevant factors may include property condition, roof size and configuration, roof pitch or slope, existing roofing materials, access and staging conditions, hidden deterioration, structural conditions, building codes, product approvals, permit requirements, municipal requirements, homeowners association or condominium association requirements, weather, material availability, manufacturer requirements, and insurance requirements.
No statement on the Website guarantees that a particular service, product, material, price, schedule, financing option, permit, inspection result, insurance result, or project outcome will be available or appropriate for a particular property.
7. Estimates, Quotes, and Calculators
7.1 Every Preliminary Estimate is preliminary and non-binding unless expressly identified as final in a Signed Contract.
7.2 A Preliminary Estimate may be based on information you supply or information obtained from third-party sources and may not reflect all conditions affecting the property.
7.3 A final price may require an in-person inspection and may change because of concealed or previously unknown damage, deteriorated roof decking, structural damage, water or mold damage, code-required improvements, permit requirements, engineering requirements, material changes, customer-requested upgrades, access limitations, additional labor, change orders, or conditions not reasonably visible during the initial evaluation.
7.4 Submitting a form or requesting an estimate does not create a contractor-client relationship and does not obligate SafeTech to accept or perform a project. A binding construction agreement exists only after the appropriate parties execute a Signed Contract.
8. No Guarantee of Service Availability
Services are subject to availability, property location, project type, safety requirements, staffing, material availability, weather, licensing limitations, permitting, and other operational considerations. SafeTech reserves the right to decline any request, inspection, estimate, project, or service opportunity at its discretion, subject to applicable law.
9. Same-Day, Emergency, and Expedited Services
9.1 The Website may describe same-day inspections, emergency roof repair, storm response, 24-hour response, expedited replacement, one-to-three-day replacement timelines, and rapid scheduling. These descriptions represent service goals or potential availability. They are not guaranteed response, start, completion, inspection, or installation times.
9.2 Timing may be affected by hurricanes and tropical storms, severe weather, high customer demand, road closures, safety conditions, crew availability, material shortages, permit processing, required inspections, engineering, association approvals, and conditions outside SafeTech’s reasonable control.
9.3 If there is an immediate danger to a person, contact 911 or the appropriate emergency authority.
10. Inspections, Drone Flights, and Aerial Imagery
10.1 Roof inspections, drone inspections, aerial photographs, visual reviews, and similar services are limited to conditions reasonably visible or detectable at the time of the inspection.
10.2 Unless expressly stated in a Signed Contract, an inspection is not a structural engineering inspection, a mold assessment, an environmental assessment, a guarantee that no concealed defect exists, a guarantee of remaining roof life, a guarantee of insurance coverage, a permit or code-compliance certification, or a warranty against future leaks or damage.
10.3 Weather, access, roof coverings, insulation, interior finishes, concealed components, and other limitations may prevent defects from being observed.
Drone Authorization
10.4 By requesting a drone inspection or aerial imagery, you represent that you are the property owner or that you are authorized by the property owner to consent to the flight and to the capture of images of the property.
10.5 You consent to SafeTech and its authorized operators using an unmanned aircraft to photograph, video, and measure the property and its improvements for the purpose of evaluating and documenting the requested work.
10.6 Drone operations are conducted under FAA Part 107. SafeTech will not fly where it lacks authorization, where airspace restrictions apply, or where conditions are unsafe.
11. Permits, Codes, and Association Approvals
11.1 Work may require building permits, municipal inspections, engineering, product approvals, Miami-Dade Notices of Acceptance, Florida Product Approvals, homeowners association approval, condominium association approval, historical-district approval, lender approval, insurance approval, or other governmental or private authorization.
11.2 Unless otherwise stated in a Signed Contract, the property owner is responsible for providing accurate ownership and property information; identifying association or condominium requirements; providing access to the property; obtaining necessary owner, tenant, lender, or association authorization; disclosing known violations; disclosing existing liens or claims; disclosing unpermitted work; and cooperating with inspections and permit requirements.
11.3 SafeTech cannot guarantee that a municipality, county, building department, inspector, engineer, insurer, lender, association, manufacturer, or other third party will approve a proposed project, product, or installation method.
12. Insurance and Claims Information
12.1 SafeTech is not an insurance company, insurance carrier, insurance agent, public adjuster, or law firm.
12.2 Information on the Website regarding insurance claims, wind mitigation, hurricane deductibles, replacement-cost value, actual-cash value, depreciation, insurance discounts, credits, or potential coverage is general information only.
12.3 SafeTech does not interpret insurance policy provisions, advise on coverage or duties under a policy, or adjust claims on behalf of any insured.
12.4 SafeTech does not guarantee insurance coverage, claim approval, claim payment, payment amount, reimbursement, premium reductions, wind-mitigation credits, deductible treatment, insurer timelines, or any insurer’s interpretation of a policy.
12.5 Direct insurance questions to your insurance carrier, licensed insurance agent, licensed public adjuster, or attorney.
Required Florida Notice
The consumer is responsible for payment of any insurance deductible.
It is insurance fraud punishable as a felony of the third degree for a contractor to knowingly or willfully, and with intent to injure, defraud, or deceive, pay, waive, or rebate all or part of an insurance deductible applicable to payment to the contractor for repairs to a property covered by a property insurance policy.
It is insurance fraud punishable as a felony of the third degree to intentionally file an insurance claim containing any false, incomplete, or misleading information.
12.6 SafeTech does not offer any rebate, gift, gift card, cash, coupon, waiver of an insurance deductible, or other thing of value in exchange for allowing a roof inspection or for making an insurance claim.
13. Assignment of Insurance Benefits
13.1 SafeTech does not accept, solicit, or take an assignment of post-loss benefits under any property insurance policy.
13.2 Under Florida law, a policyholder may not assign post-loss insurance benefits under a residential or commercial property insurance policy issued on or after January 1, 2023, and any attempted assignment under such a policy is void and unenforceable.
13.3 You remain the party responsible for payment to SafeTech under a Signed Contract, regardless of the status, timing, or outcome of any insurance claim.
14. Financing Information
14.1 Financing information on the Website is general information only. It is not a loan offer, a credit decision, financial advice, a promise of approval, or a guarantee of a particular rate or payment.
14.2 Financing may be provided by independent third-party lenders and may depend on credit approval, income verification, property eligibility, loan amount, interest rate, annual percentage rate, fees, repayment period, underwriting standards, and other lender requirements.
14.3 Any monthly payment shown through a calculator is an estimate. Actual rates, payments, fees, approval decisions, and terms are determined by the lender.
14.4 SafeTech is not responsible for a lender’s approval decisions, disclosures, rates, systems, services, delays, or conduct.
15. Transactional Telephone, Text, and Email Communications
15.1 When you provide a telephone number or email address, submit a form, request an inspection or estimate, schedule an appointment, or otherwise ask SafeTech to contact you, you authorize SafeTech and its Service Providers to send you Transactional Communications.
15.2 SafeTech may use communication platforms, including JustCall, to make and receive calls, send and receive text messages, manage voicemail, schedule follow-ups, and maintain communication records.
15.3 Communications may come from (954) 665-3231, (954) 758-4900, or other telephone numbers clearly associated with or used on behalf of SafeTech. Each number SafeTech uses for outbound calls and texts is capable of receiving return calls and return text messages.
15.4 Communications may be made through live telephone calls, text messages, email, voicemail, automated dialing systems, and prerecorded or artificial voice technology where legally permitted and properly authorized.
16. Marketing Communications and Consent
16.1 Where you have provided the consent required by applicable law, SafeTech may send you Marketing Communications about roofing services, roof inspections, roof repairs, roof replacements, storm-related services, impact windows, impact doors, construction services, financing opportunities, promotions, seasonal maintenance, and related services.
16.2 Consent to receive Marketing Communications is not a condition of purchasing any goods or services.
16.3 You represent that you are the subscriber, owner, or customary user of any telephone number or email address you provide, that the contact information is accurate, and that you will notify SafeTech if the number is reassigned or you no longer use it.
16.4 SafeTech does not sell or share mobile telephone numbers, text-message opt-in information, or consent records with third parties for those parties’ own marketing purposes. SafeTech’s handling of other contact information, including information obtained from or shared with marketing partners, is described in the Privacy Policy.
SafeTech Text Message Program — Program Disclosure

Purpose: appointment, inspection, estimate, project, and promotional messages. Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP to cancel. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase. See the Terms and Conditions and the Privacy Policy at safetechbuilders.com.
17. Revoking Consent and Opting Out
17.1 You may revoke consent to Marketing Communications at any time by any reasonable method that clearly communicates your request, including:
- Replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to a text message
- Asking any SafeTech representative to stop calling or texting
- Leaving an opt-out request by voicemail

- Using the unsubscribe link in a marketing email
17.2 SafeTech will honor a marketing opt-out request within 10 business days of receipt, and sooner where reasonably practicable.
17.3 For text-message solicitations, SafeTech will cease sending solicitations within 15 days after receiving your request, except for a single message confirming the request. That confirmation message will contain no marketing content.
17.4 If a SafeTech messaging platform cannot accept a reply, SafeTech will identify an alternative reasonable method of revoking consent in the message.
17.5 Opting out of Marketing Communications does not prevent SafeTech from sending Transactional Communications.
18. Call Recording and Monitoring
18.1 SafeTech may record or monitor telephone calls for quality assurance, training, customer service, documentation, security, dispute resolution, and compliance.
18.2 Florida requires the consent of all parties to the recording of a telephone communication. SafeTech will provide notice at the beginning of a call that may be recorded.
18.3 By continuing a call after receiving a recording notice, you consent to the recording of that call. If you do not consent, tell the representative and the call will not be recorded, or you may end the call.
19. Acceptable Website Use
You agree not to:
- Use the Website for an unlawful purpose
- Provide false or misleading information
- Impersonate another person or entity
- Submit information without authorization
- Attempt to gain unauthorized access to systems
- Introduce viruses or malicious code
- Interfere with Website operation or security
- Scrape or harvest Website information without written permission
- Copy Website content for commercial use
- Use automated tools to overload the Website
- Use Website information for spam or unlawful solicitation
- Attempt to reverse engineer Website tools or software
- Circumvent security or access restrictions
SafeTech may restrict or terminate access to the Website if it reasonably believes these Terms have been violated.

Protected materials include text, photographs, videos, graphics, logos, service names, designs, layouts, forms, calculators, icons, software, and project images.
20.2 You may view and print Website content for personal, noncommercial use related to evaluating SafeTech’s Services.
20.3 You may not reproduce, distribute, modify, publish, sell, license, create derivative works from, or commercially exploit Website materials without written permission.
20.4 If you believe content on the Website infringes your copyright, send a notice to info@safetechbuilders.com identifying the work, the location of the material, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement made under penalty of perjury that you are authorized to act on the owner’s behalf.
21. Information and Materials You Submit
21.1 When you provide property information, photographs, videos, plans, messages, testimonials, reviews, or other materials, you represent that you have the right to provide them, that the information is accurate to the best of your knowledge, that the submission does not violate another person’s rights, and that the submission does not contain unlawful or malicious material.
21.2 You authorize SafeTech to use submitted materials as reasonably necessary to respond to your inquiry, evaluate the property, prepare an estimate, provide requested Services, maintain business records, resolve disputes, and comply with legal obligations.
21.3 SafeTech will not use your name, street address, or other information that directly identifies you in public marketing without your permission or another lawful basis. Photographs and video of completed work may be used in marketing without identifying the customer or the specific street address.
22. Testimonials and Reviews
22.1 Testimonials and reviews reflect the experiences and opinions of individual customers. Results vary, and testimonials do not guarantee that another customer will receive the same price, timeline, insurance result, project result, financing result, or customer experience.
22.2 SafeTech does not provide compensation in exchange for a positive review. Where any material connection exists between SafeTech and a reviewer, that connection will be disclosed.
22.3 Third-party review platforms operate independently. SafeTech is not responsible for their content, availability, terms, or privacy practices.
23. Third-Party Websites and Services
23.1 The Website may link to or integrate with third-party services, including JustCall, financing providers, mapping services, review platforms, social-media platforms, scheduling systems, customer-relationship management systems, analytics providers, advertising platforms, manufacturers, suppliers, and government websites.
23.2 SafeTech does not control these third parties and is not responsible for their content, products, services, security, availability, privacy practices, terms, or accuracy. Your use of third-party services is governed by the third party’s terms and privacy policy.
24. Website Availability and Accuracy
24.1 SafeTech attempts to maintain accurate and current Website information but does not guarantee that every page, tool, price, description, license reference, promotion, service area, financing term, or feature is complete, current, available, secure, uninterrupted, or error-free.
24.2 SafeTech may change or remove Website content, services, promotions, hours, service areas, prices, or features without notice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SAFETECH DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES REGARDING THE WEBSITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
This Website disclaimer does not replace warranties expressly provided in a Signed Contract or an applicable manufacturer warranty.
27. Limitation of Liability
27.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFETECH AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE WEBSITE, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY, WHETHER OR NOT SAFETECH WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
27.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF SAFETECH AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO SAFETECH FOR ACCESS TO THE WEBSITE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
27.3 These limitations apply to damages resulting from Website interruptions, reliance on a Preliminary Estimate, estimate inaccuracies, lost data, third-party services, unauthorized access, malware, missed communications, and lost opportunities.
27.4 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for gross negligence, willful misconduct, or fraud.
27.5 These limitations apply to Website use only and do not replace or reduce the provisions of a Signed Contract or an applicable manufacturer warranty.
28. Indemnification
28.1 To the extent permitted by law, you agree to indemnify, defend, and hold harmless SafeTech and its owners, officers, directors, employees, agents, contractors, and Service Providers from and against any claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorney fees and costs at trial and on appeal, arising from or relating to your unlawful use of the Website, your violation of these Terms, information or materials you submit, your misrepresentation of authority to consent to contact or to a drone flight, or your infringement of another person’s rights.
28.2 SafeTech may assume the exclusive defense and control of any matter subject to indemnification, at your expense. You agree to cooperate with that defense and will not settle any matter without SafeTech’s prior written consent.
29. Delays and Force Majeure
29.1 SafeTech is not liable for any delay or failure to perform, or for any Website interruption, caused by conditions beyond its reasonable control, including hurricanes, tropical storms, floods, fire, severe weather, declared states of emergency, epidemic, labor disruption, material or equipment shortages, supply-chain interruption, utility or telecommunications failure, internet or hosting outage, cyberattack, act of war or terrorism, civil unrest, or governmental action including permit or inspection delays.
29.2 This Section governs the Website. Delay and force majeure on a construction project are governed by the Signed Contract.
30. Dispute Resolution, Binding Arbitration, Class Action Waiver, and Jury Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION RATHER THAN IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT WITHIN 30 DAYS UNDER SECTION 30.9.
30.1 Covered Disputes
This Section applies to any dispute, claim, or controversy between you and SafeTech arising out of or relating to the Website, these Terms, the Privacy Policy, any online form or calculator, any marketing, and any telephone call, text message, voicemail, or email communication between you and SafeTech or anyone acting on SafeTech’s behalf, whether based on contract, tort, statute, regulation, or any other legal theory, and whether the claim arose before or after these Terms took effect.
30.2 Excluded Disputes
This Section does not apply to: (a) any claim that may be brought in a small claims court of competent jurisdiction, so long as the claim remains on an individual basis in that court; (b) any action by either party seeking injunctive or equitable relief for infringement or misuse of intellectual property; or (c) any dispute arising under a Signed Contract, which is governed by the dispute resolution provisions of that contract.
30.3 Informal Resolution First
Before starting an arbitration, the party raising the dispute must send a written Notice of Dispute describing the claim and the relief sought. Your notice goes to info@safetechbuilders.com and to SafeTech Builders Inc., c/o info@safetechbuilders.com, Pembroke Pines, FL. SafeTech’s notice goes to the contact information you provided. The parties will attempt in good faith to resolve the dispute for 60 days after the notice is received. Either party may request that the dispute be submitted to a single mediator during that period, with mediation costs shared equally.
30.4 Binding Arbitration
If the dispute is not resolved within 60 days, it will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, before a single arbitrator. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
30.5 Location and Costs
Arbitration will be conducted in the Florida county where you reside, or by telephone, videoconference, or documents-only submission at your election. SafeTech will pay all AAA filing, administrative, and arbitrator fees that exceed what you would have paid to file the same claim in a Florida court of competent jurisdiction. The arbitrator will award reasonable attorney fees and costs to the prevailing party.
30.6 Class Action Waiver
YOU AND SAFETECH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MORE THAN ONE PERSON AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF ON THAT PARTY’S INDIVIDUAL CLAIM.
30.7 Jury Trial Waiver
TO THE EXTENT ANY DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND SAFETECH EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY.
30.8 Severability of This Section
If the class action waiver in Section 30.6 is found unenforceable as to any claim or any request for particular relief, then that claim or request for relief will be severed and decided by a court of competent jurisdiction in Broward County, Florida, and the remainder of the dispute will proceed in arbitration. Under no circumstance will class, collective, or representative arbitration be permitted. If Section 30.6 is found unenforceable in its entirety, then this entire Section 30 is void, except for Section 30.7.
30.9 30-Day Right to Opt Out
You may opt out of this Section 30 by sending written notice within 30 days after you first accept these Terms. Send your full name, the telephone number and email address you provided, and a clear statement that you opt out of arbitration to info@safetechbuilders.com with the subject line “Arbitration Opt-Out,” or by mail to SafeTech Builders Inc., c/o info@safetechbuilders.com, Pembroke Pines, FL. Opting out does not affect any other part of these Terms and will not affect your relationship with SafeTech in any other way.
30.10 Delegation
The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this Section, except that a court has exclusive authority to decide the enforceability of Section 30.6.
31. Time Limit for Bringing Claims
To the extent permitted by law, any claim arising out of or relating to the Website or these Terms must be filed within one year after the claim arose. A claim not filed within that period is permanently barred. This Section does not apply to any claim arising under a Signed Contract.
32. Governing Law and Venue
32.1 These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
32.2 Subject to Section 30, any dispute arising solely from the Website or these Terms that is not subject to arbitration must be brought exclusively in a state or federal court of competent jurisdiction located in Broward County, Florida. Each party consents to the personal jurisdiction of those courts and waives any objection based on venue or forum non conveniens.
33. Construction Contracts Control
33.1 These Terms govern Website use.
33.2 If you enter into a Signed Contract with SafeTech, that contract governs the construction, installation, inspection, payment, warranty, cancellation, dispute, and project relationship.
33.3 If these Terms conflict with a Signed Contract, the Signed Contract controls as to the contracted Services.
33.4 Nothing in these Terms waives, limits, or modifies any right you have under Florida law, including any statutory right to cancel a contract within the period provided by law.
34. Children’s Use
The Website is intended for adults seeking construction or property-related services. It is not directed to children under 13, and children under 13 should not provide personal information through the Website.
35. Changes to These Terms
35.1 SafeTech may update these Terms periodically. The revised Terms will be posted on this page with an updated “Last Updated” date and version number.
35.2 For material changes, SafeTech will provide reasonable advance notice by posting a notice on the Website or by contacting you using the information you provided.
35.3 Your continued use of the Website after the revised Terms take effect means you accept them. Changes do not apply retroactively to a dispute of which SafeTech had notice before the change.
36. Notices
Notices to SafeTech must be sent to info@safetechbuilders.com or by mail to SafeTech Builders Inc., c/o info@safetechbuilders.com, Pembroke Pines, FL. Notices to you may be sent to the email address, telephone number, or mailing address you provided, or posted on the Website.
37. Assignment
You may not assign or transfer these Terms or any rights under them without SafeTech’s prior written consent. SafeTech may assign these Terms without restriction, including in connection with a merger, acquisition, financing, reorganization, or sale of assets.
38. Entire Agreement
These Terms, together with the Privacy Policy, are the entire agreement between you and SafeTech regarding the Website and supersede all prior or contemporaneous understandings regarding the Website. This Section does not limit any Signed Contract.
39. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full effect. Section 30.8 governs severability within Section 30.
40. No Waiver
SafeTech’s failure to enforce any provision does not waive its right to enforce that provision later. A waiver is effective only if made in writing and signed by an authorized SafeTech representative.
41. Survival
Sections 2, 13, 20, 21, 26, 27, 28, 30, 31, 32, 36, 38, 39, 40, and 41 survive any termination of your use of the Website.
42. Headings and Third-Party Beneficiaries
Headings are for convenience only and do not affect interpretation. Except for the parties identified in Sections 27 and 28, these Terms create no third-party beneficiary rights.
